STANDARD BUSINESS PRODUCT WARRANTY

B & T Associates Limited trading as Lumineux Lighting | Business customers and business end users only

1. Status and scope

  • 1.1 This Standard Business Product Warranty applies only to Lumineux and other B & T Associates Limited branded Products acquired for business use, supplied for installation in the United Kingdom under a business-to-business Contract. It may be used only by the Customer or an eligible business end user under clause 1.2. It does not apply to a Consumer or a consumer sale. It forms part of the applicable Contract and is subject to the Terms and Conditions of Sale version identified when the Contract was formed. If there is a conflict, the Terms of Sale prevail unless an Order Acknowledgement expressly states otherwise.
  • 1.2 A claim may be made by the Customer or, where the Product was bought through an authorised distributor or contractor, by the original business end user with proof tracing the Product to the Supplier. Cover may transfer with the Product at the original installation address to a subsequent business owner or occupier that provides reasonable proof of purchase, provenance and continued compliance with this Warranty. It does not transfer to a different site without the Supplier’s written approval. A claimant obtains no greater rights than the Customer and the Supplier may require the claim to be submitted through the original point of purchase where reasonably practicable.

2. Warranty promise and period

  • 2.1 During the Warranty Period, the Supplier warrants that the Products will be free from material defects in design (where designed by the Supplier), materials and workmanship and will materially conform to the Specification identified when the Contract was formed.
  • 2.2 “Warranty Period” means the exact period stated for the relevant SKU in the Order Acknowledgement or identified product specification in force on the Order date, beginning on the date the Product is delivered or collected or, if later, the invoice date. The Order Acknowledgement should identify the SKU and revision, applicable Warranty Period, any operating-hours limitation, this Warranty version, the Returns & Credits Policy version and any registered On-Site Warranty. A warranty icon or statement in an expressly identified Catalogue establishes a period only where it clearly applies to the ordered SKU and is not superseded by the Order Acknowledgement or an expressly identified SKU datasheet. A reference to “up to” a period does not itself grant that period. Where no product warranty period is stated, the Terms of Sale and statutory rights apply without an additional time-limited product warranty.
  • 2.3 Any total operating-hour limit or usage profile stated in the Specification applies in addition to elapsed time. An LED lifespan, L70 or other lumen-maintenance figure is a projection, not a guaranteed failure-free life, service life or Warranty Period. Lumen depreciation is assessed against the published metric for the relevant SKU, including any stated L/B value, rated operating hours, ambient temperature and duty cycle. Unless the Specification states otherwise, a usage assumption is not a basis for extending the Warranty Period.
  • 2.4 A repaired or replacement Product is covered only for the unexpired balance of the original Warranty Period.

3. Emergency batteries

  • 3.1 Unless the applicable Specification states otherwise: nickel-cadmium (NiCd) emergency batteries have a two-year warranty; lithium iron phosphate (LiFePO4) emergency batteries have a five-year warranty; and batteries in E-SEL3-labelled Products have a five-year warranty. The product specification prevails if it states a different period.
  • 3.2 Battery cover applies to a defect in the battery component during its stated component Warranty Period. Normal capacity reduction through age, use, temperature or cycling, and routine replacement at the end of the battery’s published service life or cycle limit, are not defects. Where the published service life or cycle limit is shorter than the Product Warranty Period, it does not extend the battery component cover. Labour, access and disposal costs are excluded unless an activated On-Site Warranty expressly covers them.

4. Installation and standards

  • 4.1 Products must be transported, stored, installed, commissioned, used, tested and maintained by competent persons in accordance with law, the Specification, the Product Information identified when the Contract was formed and the standards properly applicable when the relevant work was carried out.
  • 4.2 Electrical installations must comply with the edition and amendments of BS 7671 properly applicable at the date of design and installation, including any formally recognised transition period. Emergency-lighting systems must, where relevant, comply with the editions properly applicable at the relevant design, installation and commissioning dates, including BS 5266-1:2025 and BS EN 50172:2024, and be supported by the records reasonably required by those standards.
  • 4.3 Surge-protection requirements and SPD selection, location and coordination must be determined by the competent designer or installer under the properly applicable edition of BS 7671, the site assessment, electrical design and Product Information. Evidence of that design decision may be requested only where reasonably relevant to the nature and likely cause of a suspected overvoltage-related failure.
  • 4.4 The applicable cleaning, inspection, emergency-lighting testing, battery storage and replacement, ambient-temperature, switching-cycle, operating-hours, commissioning and maintenance requirements are those stated in the Specification or Product Information identified when the Contract was formed. The Order Acknowledgement should identify those documents by title, revision or a durable web address. A later change to a website document does not retrospectively impose a new requirement on an existing Contract.

5. What is not covered

The Warranty does not apply to the extent the failure was caused or materially contributed to by:

  • normal wear and tear, lumen depreciation within the published SKU metric described in clause 2.3, or consumption of a replaceable component;
  • failure to follow installation, commissioning, maintenance, testing, storage or operating instructions;
  • operation outside rated voltage, frequency, temperature, IP/IK rating, orientation, duty cycle or other published limits;
  • transient overvoltage, lightning, switching surge, harmonic distortion, poor power quality, inadequate earthing or supply instability, but only where: (a) the failure is reasonably consistent with that condition; (b) surge protection or another protective measure was required by the properly applicable standard, site assessment, Product Information or electrical design; and (c) its absence, inadequacy or incorrect coordination caused or materially contributed to the failure. The absence of an SPD or design record does not, by itself, invalidate this Warranty;
  • incompatible or unapproved dimmers, drivers, emergency packs, controls, networks, software or other third-party equipment;
  • misuse, accident, impact, vandalism, contamination, ingress, excessive vibration, chemical, corrosive, coastal or high-sulphur exposure for which the Product is not rated;
  • unauthorised opening, modification, repair, relocation or alteration;
  • incorrect drainage, sealing, cabling, mounting, ventilation or thermal management; or
  • a design, specification, instruction, material or component supplied or required by the Customer.

6. Making a claim

  • 6.1 The claimant must notify the Supplier promptly and normally within 30 days after discovering the suspected defect. Delay does not invalidate a claim unless and to the extent it materially prejudices investigation or mitigation.
  • 6.2 The claim must include proof of purchase, Product and batch or serial details, quantity affected, fault description, installation date and location, and reasonable photographs or other initial evidence. The Supplier may request certificates, commissioning, test, maintenance, surge-protection, control-system or other evidence only where reasonably relevant to the nature and likely cause of the suspected failure and reasonably necessary to determine whether a covered defect exists.
  • 6.3 The Supplier will not reject a claim solely because an installation, commissioning or maintenance document is unavailable. Where it relies on an installation, operating or maintenance failure, the Supplier must reasonably identify the relevant failure and how it caused or materially contributed to the claimed defect. A claim may nevertheless be declined where the claimant fails to provide information reasonably necessary to determine whether a covered defect exists.
  • 6.4 The claimant must preserve the affected Products, must not dispose of or repair them without written approval, and must provide reasonable access for inspection and testing. Returns require written authorisation, suitable packaging and compliance with the Returns & Credits Policy version identified in the Order Acknowledgement or RMA. That Policy is procedural and does not reduce any remedy due for an accepted valid warranty claim. The Supplier bears reasonable authorised return carriage for an accepted valid claim; otherwise the claimant bears it.

7. Remedies

  • 7.1 If the Supplier accepts a valid claim, it may at its option repair the affected Product, replace it with the same or nearest reasonably equivalent Product, or refund or credit the net price paid for the affected Product.
  • 7.2 A replacement must be reasonably equivalent in essential safety, electrical, regulatory and functional performance. It may differ in appearance, dimensions, colour, photometric performance, controls or other non-essential specification where the original has been discontinued or superseded. The Supplier is not required to replace unaffected Products solely to maintain uniformity.
  • 7.3 Unless an activated On-Site Warranty applies, the Standard Business Product Warranty does not cover diagnosis, removal, installation, access equipment, travel, accommodation, making good, project delay, business interruption or other on-site costs.
  • 7.4 If testing shows no covered defect, the Supplier may charge reasonable, evidenced testing, handling, storage and carriage costs notified in advance.

8. Batch and multiple failures

  • 8.1 Where a verified defect affects a production batch or component, the remedy is limited to affected Products. Sampling, inspection and a proportionate replacement programme may be used where technically reasonable. The Supplier is not responsible for replacing unaffected luminaires within the installation.

9. Liability and mandatory rights

  • 9.1 The liability exclusions and aggregate cap in the Terms and Conditions of Sale apply to this Warranty. Nothing in this Warranty excludes liability or a remedy that cannot lawfully be excluded or limited.

10. Version control and contact

  • 10.1 The version identified when the Contract is formed applies for the Warranty Period. A later version applies only to later Contracts unless agreed in writing. Claims should be submitted to [email protected] with the information in clause 6. The Supplier aims to acknowledge a complete claim within five Business Days and to provide a reasoned decision within ten Business Days after receiving the evidence reasonably necessary to assess it. These are service targets, not guaranteed time limits, and may be extended where technical testing, site access, third-party information or batch investigation is reasonably required.

ON-SITE WARRANTY TERMS & CONDITIONS

Additional B2B cover supplementing the Standard Business Product Warranty | Consumers excluded

1. Relationship with the Standard Business Product Warranty

  • 1.1 This On-Site Warranty is optional additional business-to-business cover for the Customer or an eligible business end user under the Standard Business Product Warranty. It applies only to Products acquired for business use and does not apply to a Consumer or a consumer sale. It applies together with the Standard Business Product Warranty and Terms and Conditions of Sale identified when the relevant Contract was formed. The Standard Business Product Warranty definitions, eligibility, conditions, exclusions, claim evidence, remedies and liability provisions apply equally to this On-Site Warranty.
  • 1.2 If there is a conflict, the Terms of Sale prevail, followed by the Standard Business Product Warranty, this On-Site Warranty and then the registration confirmation. Despite that order of priority, an express project-specific provision in the registration confirmation may increase the limits or benefits available under this On-Site Warranty for that registered project, but may not reduce rights already granted by the higher-priority documents.

  • 2. Eligibility and activation
    2.1 On-site cover is available only for Products carrying a Standard Business Product Warranty Period of five years or more, unless the Order Acknowledgement expressly states otherwise. Products with shorter cover, consumables and batteries with a shorter component warranty are not eligible except where expressly listed in the registration confirmation.
  • 2.2 The project must be registered at https://www.lumineux.co.uk/on-site-warranty-registration within 90 days after the commencement date of the applicable Standard Warranty Period. Registration must include proof of purchase, project address, Products and quantities, installation date, installer details and other information reasonably relevant to eligibility. The project is ‘registered’ only when the Supplier issues a unique written registration confirmation.
  • 2.3 Unregistered Products remain subject to the Standard Business Product Warranty only. Registration may transfer to a subsequent business owner or occupier at the same registered location, subject to written notice, reasonable proof of provenance and continued compliance. It is not transferable to another site without written approval and does not extend the Standard Warranty Period.
  • 2.4 Registration confirms eligibility for potential on-site cover. On-site cost cover is ‘activated’ for a particular claim only when the accepted covered failures satisfy clause 4 and the Supplier issues the written pre-authorisation required by clause 5. Registration alone does not authorise work or expenditure.

3. Conditions

  • 3.1 All conditions of the Standard Business Product Warranty apply. In particular, Products and the installation must comply with the Specification, identified Product Information and the editions and amendments of applicable standards properly applicable at the relevant design, installation and commissioning dates, including any formally recognised transition period and, where relevant, BS 7671, BS 5266-1:2025 and BS EN 50172:2024.
  • 3.2 The claimant must provide the evidence reasonably relevant to the nature and likely cause of the suspected failure under the Standard Business Product Warranty, together with reasonable site-access, risk-assessment, induction and health-and-safety information. The Supplier may inspect, test, sample and require return of affected Products before authorising work.

4. Activation threshold

  • 4.1 On-site cost cover is activated only where accepted covered failures at the same registered location, arising from the same or a materially related cause, meet either threshold during a rolling 90-day period: (a) more than 2% of the registered Lumineux Products at that location; or (b) at least four registered Lumineux Products.
  • 4.2 Products that have not failed, are not eligible, or failed for a cause excluded under the Standard Business Product Warranty are not counted. Below the threshold, accepted claims are handled under the Standard Business Product Warranty on a return-to-base/product-supply basis.

5. Pre-authorisation and control of works

  • 5.1 No labour, access-equipment or other cost is covered unless the Supplier first confirms in writing that the claim is eligible and authorises the scope, contractor and rates. Emergency safety work may be undertaken without prior approval only where reasonably necessary to prevent imminent injury or material property damage, with notice and evidence provided as soon as practicable.
  • 5.2 The Supplier may appoint its own qualified contractor or require the claimant to use an approved contractor. The Supplier may choose a technically reasonable repair, component replacement or luminaire replacement method. Unauthorised works are not reimbursable.

6. Covered on-site costs and limits

  • 6.1 For an authorised claim, cover is limited to reasonable, evidenced costs necessarily incurred solely to remove and replace or repair accepted defective Products:
  • labour at no more than £30 per hour, for a maximum of eight labour hours per claim; and
  • access equipment at no more than £375 per claim.

  • 6.2 The limits are exclusive of VAT only where VAT is properly chargeable and irrecoverable by the claimant. They are per accepted claim and not per Product. Related failures or invoices arising from the same underlying cause at the same site are one claim. The Supplier’s written registration confirmation may state higher project-specific limits.
  • 6.3 Payment is made against a valid invoice and time sheets or supplier receipts after completion and verification. The Supplier may pay the authorised contractor directly.

7. Excluded on-site costs

In addition to the Standard Business Product Warranty exclusions, on-site cover does not include:

  • fault-finding or investigative work unrelated to a covered Product defect;
  • travel, mileage, parking, tolls, accommodation, subsistence or call-out charges;
  • traffic management, road closures, permits, security escorts, specialist lifting beyond the authorised access-equipment allowance, scaffolding, cranes or rope access;
  • making good ceilings, finishes, decorations, structures, cabling, controls or third-party equipment;
  • out-of-hours, weekend or premium rates unless authorised in advance;
  • design, testing or rectification of the wider electrical installation;
  • loss of profit, revenue, goodwill, use, data, business interruption, project delay or other indirect or consequential loss; or
  • costs above the limits in clause 6 or the applicable registration confirmation.

8. Claims and completion

  • 8.1 Claims must be submitted at https://www.lumineux.co.uk/on-site-warranty-claim or to [email protected] and must quote the unique registration reference. The Supplier aims to acknowledge a complete claim within five Business Days and to provide a reasoned decision within ten Business Days after receiving the evidence reasonably necessary to assess it. These are service targets rather than guaranteed response times and may be extended where technical testing, site access, third-party information or batch investigation is reasonably required. The claimant must mitigate loss and isolate unsafe equipment where competent to do so.
  • 8.2 Authorised work must be completed within the approval period and in accordance with the approved method. The contractor must provide completion evidence and comply with site safety and electrical certification requirements. Replaced Products become the Supplier’s property if requested.

9. Liability and duration

  • 9.1 This On-Site Warranty adds only the cost cover expressly stated above. It does not increase the liability cap or alter the excluded-loss provisions in the Terms and Conditions of Sale. Nothing excludes liability or a remedy that cannot lawfully be excluded or limited.
  • 9.2 On-site cover ends when the underlying Standard Business Product Warranty Period for the relevant Product ends. A repaired or replacement Product remains covered only for the unexpired balance.
